Welcome to the www.phonedirectorysettlement.com Important Updates: By Decision dated May 1, 2007, the Superior Court of New Jersey Appellate Division affirmed the trial Court's approval of the Settlement. The time period for which any motion for leave to appeal the Appellate Division Decision to the New Jersey Supreme Court has expired and the Settlement has become final and effective. Settlement benefits have been issued to Class Members who filed timely and valid claims. The Settlement resolves a class action brought in the Superior Court of the State of New Jersey, Bergen County (the "Court"), known as The Education Station Day Care Centers, Inc. vs. Yellow Book USA, Inc. and related class actions filed in other courts. These lawsuits alleged that Yellow Book made false statements concerning phone directory possession, usage and preference. While Yellow Book believed that the allegations in the lawsuits were without merit, the parties agreed to settle the lawsuits to avoid the time, expense, and delay of protracted litigation. The Settlement is not an admission of wrongdoing and does not indicate a violation of any law. The settlement applies to certain individuals and businesses (called "Class Members" or the "Settlement Class") who, between the dates of May 7, 2002 and July 31, 2004, inclusive (the “Class Period”) signed one or more contracts pursuant to which they paid money to Yellow Book USA, Inc. to purchase advertising in a Yellow Book directory and are not otherwise excluded. The deadline for submitting a Claim Form under this Settlement passed on September 22, 2005, and no additional Claim Forms will be accepted. The deadline for Class Members to object or exclude themselves from the Settlement passed on August 2, 2005, and no new objections or exclusions will be accepted. Under the terms of the Settlement, Yellow Book has issued to Settlement Class Members who timely submitted a valid Claim Form and as of April 1, 2005, are Current Customers of Yellow Book, a credit toward the purchase of future Yellow Book advertising. Yellow Book has issued to Settlement Class Members who timely submitted a valid Claim Form and, as of April 1, 2005, who are Former Customers of Yellow Book, either (a) a credit toward the purchase of future Yellow Book advertising, or (b) a cash payment, as selected by the Class Member on their submitted Claim Form.
